Terms of Service

The rules for using the Covebyte website and services. Please read them carefully.

Last updated November 4, 2026

1. Agreement to these terms

These Terms of Service ("Terms") govern your use of the Covebyte website and services. By using them, you agree to these Terms. If you use our services for an organisation, you confirm you are authorised to accept these Terms on its behalf.

Customers with a signed order form or master services agreement are also bound by that agreement, which takes priority if it conflicts with these Terms.

2. Accounts

  • You must give accurate information and keep it up to date
  • You are responsible for keeping your credentials and API keys secure
  • You are responsible for all activity under your account
  • Tell us immediately about any unauthorised use

3. Acceptable use

You must not use our services to:

  • Send spam, unsolicited marketing or messages without the recipient’s consent
  • Make illegal robocalls or break telemarketing laws such as the TCPA, or do-not-call rules
  • Commit fraud, phishing, spoofing or impersonation
  • Send content that is unlawful, harmful, harassing or infringes others’ rights
  • Interfere with or disrupt our networks or other customers
  • Try to gain unauthorised access to any system

You are responsible for getting any consent your communications require and for complying with the laws that apply to them, including 10DLC, short-code and carrier rules.

4. Fees and payment

You agree to pay the fees for the services you use, as shown in your account or order form. Usage-based fees are billed in arrears. Unless stated otherwise, fees exclude taxes, which you are responsible for. We may suspend services for overdue accounts after giving notice.

5. Service availability

We work hard to keep our services available but do not guarantee they will be uninterrupted or error-free, unless a separate service-level agreement applies. Communications depend on third-party carriers and networks outside our control. Our services are not a replacement for traditional phone service for emergency calls unless specifically stated.

6. Your data

You keep all rights to the content and data you send through our services. You give us permission to process it only to provide and improve the services, as described in our Privacy Policy.

7. Intellectual property

The services, software, documentation and Covebyte brand belong to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the services; they do not transfer ownership.

8. Suspension and termination

You may stop using the services at any time. We may suspend or end your access if you break these Terms, create risk for us or others, or if required by law or by a carrier. Sections that by their nature should survive termination will continue to apply.

9. Disclaimers

Except as expressly stated, the services are provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wyoming, unless otherwise agreed in writing.

12. Changes to these terms

We may update these Terms. We will change the "last updated" date above and give notice of material changes. Continuing to use the services after changes take effect means you accept them.
